1. Agreement to Terms

These Terms and Conditions constitute a legally binding agreement between you ("the Customer," "you," or "your") and this site ("we," "us," or "our"). If you do not agree with any part of these Terms and Conditions, you must discontinue your use of this site immediately and refrain from placing any orders.

We reserve the right to modify these Terms at any time without prior notice. Changes take effect immediately upon posting. Your continued use constitutes acceptance of the revised terms. The most recent revision date is indicated at the top of this page.

2. Eligibility

To use this site and place orders, you must be at least 18 years of age or the age of legal majority in your jurisdiction, whichever is greater. By using this site, you represent and warrant that you meet this requirement. If placing an order on behalf of another person, you represent that you have authority to bind that person to these terms. We reserve the right to refuse service, cancel orders, or close accounts at our discretion if eligibility requirements are not met.

3. Products and Descriptions

We make every effort to ensure that product descriptions, images, specifications, and pricing are accurate and complete. However, we do not warrant that all content is error-free. Product images are for illustrative purposes only and may differ slightly from actual products due to screen settings, lighting, and manufacturing processes. Minor differences in color, size, texture, or packaging do not constitute a defect unless the difference is substantial. All products are subject to availability. We reserve the right to discontinue products, limit quantities, and refuse sales for legitimate reasons.

4. Pricing and Currency

All prices are in Euros (€) and include applicable VAT unless stated otherwise. If a pricing error is discovered after your order is placed, we will notify you and offer reconfirmation at the correct price or cancellation. We are not obligated to fulfill orders at incorrect prices. Shipping costs are calculated based on your delivery location and displayed during checkout. Since this site offers Cash on Delivery, the total amount (product price, shipping, and any COD service charges) is collected by the courier at delivery. You are responsible for having the exact amount ready.

5. Order Process and Acceptance

When you place an order, it constitutes an offer to purchase subject to these Terms. The order confirmation email is an acknowledgment of receipt only, not acceptance. A binding contract is formed only when we dispatch your order and send a shipping confirmation email. Until dispatch, we may cancel or modify your order. If we cannot fulfill your order, we will notify you and no payment will be collected.

6. Cash on Delivery (COD) Payment Terms

By placing a COD order, you commit to accepting and paying for delivered products upon arrival. Refusal to accept delivery or pay without valid reason constitutes a breach and may result in: restocking and return shipping fees; account restriction or suspension; future orders being declined; and pursuit of additional legal remedies. The courier collects the full amount at delivery. If delivery fails because no one is available, the courier makes additional attempts per their policy. After all attempts, the package may be returned and you may be responsible for return shipping costs.

7. Shipping and Delivery

We ship across Europe through reputable logistics partners. Full details are on our Shipping Policy page. Delivery timeframes are estimates only and may be affected by weather, customs, holidays, courier delays, or force majeure. Risk of loss passes to you upon delivery. You are responsible for providing an accurate, complete delivery address.

8. Returns, Exchanges, and Refunds

If not satisfied, you may return eligible products per our Return and Refund Policy. All return requests must be initiated by contacting email@fabulosashop.com within the applicable return period.

9. Intellectual Property Rights

All content on this site — text, graphics, logos, trademarks, images, software, data compilations, page layouts, and overall design — is our exclusive property or that of our licensors, protected by international intellectual property laws. You receive a limited, non-exclusive, non-transferable, revocable license for personal, non-commercial use only. Unauthorized use, reproduction, distribution, or modification terminates this license without prejudice to other remedies.

10. User Accounts

You must provide accurate information when creating an account and keep credentials confidential. You are responsible for all activity under your account. Notify us immediately at email@fabulosashop.com of any unauthorized use. We may suspend or terminate accounts for violations, fraud, false information, or harmful activity.

11. Limitation of Liability

To the fullest extent permitted by law, this site shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of this site or products purchased. Our total aggregate liability shall not exceed the amount you paid for the specific product(s) giving rise to the claim. Nothing excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under applicable law, including mandatory EU consumer rights.

12. Consumer Rights Under EU Law

If you are an EU consumer, you benefit from mandatory consumer protection provisions, including the 14-day cooling-off period (Directive 2011/83/EU), the right to conforming products (Directive (EU) 2019/771), and remedies for non-conforming goods. In any conflict between these Terms and your statutory rights, your statutory rights prevail.

13. Force Majeure

We shall not be liable for failure or delay caused by circumstances beyond our reasonable control, including natural disasters, pandemics, war, terrorism, government actions, labor disputes, supply chain disruptions, power failures, internet outages, or cyber-attacks.

14. Governing Law and Jurisdiction

These Terms are governed by the laws applicable where this site is established. EU consumers also benefit from mandatory provisions of their country of residence. Disputes shall be submitted to the competent courts in our jurisdiction, without preventing you from bringing proceedings in your country if permitted by law.

15. Online Dispute Resolution

The European Commission provides an ODR platform at https://ec.europa.eu/consumers/odr. We are committed to engaging constructively with any dispute resolution proceedings initiated through this platform.

16. Severability and Entire Agreement

If any provision is found invalid, the remaining provisions continue in full force. These Terms, together with our Privacy Policy, Shipping Policy, Return and Refund Policy, and Cookie Policy, constitute the entire agreement between you and this site.
